This Privacy Policy constitutes an electronic record in terms of the Information Technology Act, 2000 and rules made there under. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published and shall be construed in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, that require publishing the rules and regulations, privacy policy and user agreement for access or usage of Platform, as defined below.

This is a legal and binding agreement between you, the user (referred to as “user” or “you” or “your”) of the Platform, as defined below, and Mavensensum LLP (together with its subsidiaries, and affiliates, hereinafter referred to as “Mavensensum” or “us” or “we” or “our” or “the Company”) stating the terms that govern your use of the Platform, as defined below. The website “www.mavensensum.com” and mobile application (collectively referred to as the “Platform”) and the information, services and other materials contained therein are provided and operated by us. We specialize in providing comprehensive insights and data-driven solutions to help our clients gain a deeper understanding of their target audience and drive business growth. We also conduct consumer surveys, consumer behaviour tracking etc. (collectively referred to as “Services”), through the Platform.

Please review our Terms of Use, Disclaimers and other policies available on the Platform (collectively referred to as the “Terms”) that govern the use of the Platform and our Services. By using the Platform in any manner or accessing the Platform, you consent, agree, and undertake to abide, be bound by and adhere to the Terms and if you do not agree to the Terms, you are not entitled to avail of/use the Platform and Services and any use thereafter shall be unauthorised. It is requested to desist from using the Platform and Services if you do not agree to the Terms.

These Terms shall apply to our hosted mobile apps, WhatsApp groups, Facebook groups, Instagram pages, Facebook pages, email/SMS/phone communications and other social media forums hosted by us, which shall be deemed to be part of the ‘Platform’ by reference. You acknowledge that certain parts of the Platform, as mentioned above, are provided by third-party service providers, and you agree to abide by their terms and conditions. We shall not be responsible for any disruption of services caused by such third-party service providers.

Although you may “bookmark” a particular portion of the Platform and thereby bypass the Terms, your use of the Platform or Services still binds you to the Terms.

We value the trust placed in us by the visitors/users of our Platform and the users of our services. Therefore, we insist on the highest standards for secure transactions and customer information privacy. We are committed to protecting the personal information including sensitive personal data as received from providers under lawful contracts or from persons directly. The following Privacy Policy describes the personal information including sensitive personal data that we collect from you as part of the normal operation of our services and the manner in which your information is used, shared and stored by us.

All terms used in this Policy and not defined hereinafter, shall have the meaning assigned to them in the Terms of Use available on the Platform.

At the outset, we wish to inform you that this Privacy Policy is subject to change without prior notification or intimation to the visitors or users of the Platform. Hence, you are advised to regularly check for any amendments or updates to this Privacy Policy.

Scope of the Policy

This Privacy Policy applies only to the actions of User of the Platform. It does not extend to any applications/websites that may be accessed from the Platform including, but not limited to any links we may provide to social media applications/websites etc.

Collection and processing of information

We collect list of applications installed in your mobile/device on a regular basis. The installed application list is used for analytics & for monetization. We also use accessibility services permission. The accessibility permission is used for analysing the application usage on the user device as part of an opt-in market research panel.

We may ask users and other lawfully contracted providers and vendors to provide personally identifiable information, that is, information that helps identify a specific individual (“Personal Information” means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person), and other sensitive personal data such as age, gender, payment details or preferences and interests etc. If such information is combined with the Personal Information we collect, the combined information shall be treated as Personal Information and shall be subject to this Privacy Policy.

We are committed to protecting the privacy and confidentiality of the information shared by users at the time of registration and user’s personal information accessed by us in accordance with applicable laws. We do not share your personal information with any third-party except in accordance with the agreement.

User Information

The Platform will require you to provide your Name, age, gender, City, Date of Birth, Children and their date of birth, educational qualification of CWE and items owned in your house. We will use your registered mobile number or email to contact you if any case need arises and an online payment transfer number to remit to you your incentive, if applicable. You understand and agree that all information provided by you is accurate, current and complete and that you will maintain and update your information to keep it accurate, current and complete.

You will also be requested from time to time to provide additional profile information about yourself on purely voluntary basis via survey questionnaires. You may be compensated for providing this information.

We use accessibility services permission with your consent. The accessibility permissions are used for analysing the Platform usage on your device as part of an opt-in market research panel. To facilitate this, the Platform collects:

Information collected automatically

In addition to any information that you voluntarily provide us, we and our third-party service providers, may use a variety of technologies that collect certain information whenever you visit or interact on the Platform (Usage Information). Usage Information may include your browser and operating system details, the URL or advertisement that referred you to our Platform, the search terms entered, all the areas within our Platform visited, the time of day and duration you visited the Platform, among other information. The technologies used to collect Usage Information include cookies, web beacons, embedded scripts, etc. Personal Information is used to provide the services you request and make recommendations based on your usage history, and users are granted the option to discontinue any communications based on such Personal Information, as far as possible. Personal Information may be used to resolve disputes; solve problems; evaluate consumer interest, provide information regarding offers, products, services, and updates; customize user experience and enforce our terms of use.

All information provided by you and data collected from your device will be anonymized and utilized at an aggregated level in summary reports and analysed as we deem fit.

You understand that we will be using the data as collected by the Platform and provided by you for the purpose of generating insights on audience measurement and Data Management Platforms for third party advertising purposes. The responses provided by you voluntarily for surveys may also be analysed and commercially used. With respect to any data you submit via the Platform or during a Survey or that is otherwise made available to us, you hereby grant us an irrevocable, worldwide, perpetual, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt, such data or response.

Security Measures

In furtherance of the confidentiality with which we treat your information, we assure you that to prevent unauthorized access, maintain data accuracy and ensure correct use of information, we will employ reasonable security practices and procedures and current internet security methods and technologies in compliance with the Information Technology Act, 2000 (India) and rules made there under. Moreover, we restrict access to your personal information to our employees, consultants and agents, except who need to know that information in order to operate, develop or improve our services. These persons are bound by confidentiality obligations and may be subject to disciplinary proceedings, including termination and criminal prosecution, if they fail to meet these obligations. However, while we use industry standard practices to protect your privacy, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications or users may abuse or misuse your personal information that they collect from the Platform. All the data provided by you will be uploaded to secure servers in India on the cloud that is controlled by us.

Retention Period

We store Information for no longer than the time period legally permitted and necessary for research purposes. The retention period depends largely on the kind of personal data, the purposes and the applicable law.

Minor’s use of the Services

We encourage parents and guardians to supervise the online activities of their minor children (below the age of 18 years) and consider using parental control tools available online and through software manufacturers, to help provide a child-friendly online environment. These tools can prevent minors from disclosing their name, address, and other personally identifiable information online without parental permission. Although the Platform is not intended for use by minors, we respect the privacy of minors who may inadvertently use the Platform. We do not knowingly collect or solicit personal information from minors or knowingly allow minors to register for the services, without prior consent of the minor’s legal guardian or parents. In the event that we are informed that we have collected personal information from a minor without prior consent of the minor’s legal guardian or parents, we will verify such information internally and delete that information as quickly as possible. If you believe that we might have any personal information from or about a minor (without due consent), please contact our Grievance Officer.

Governing Law

These Terms or any Service specific terms shall be governed by, construed and enforced in accordance with the laws of India, as these are applied to agreements entered into and to be performed entirely within India and without giving effect to any principles of conflict of laws. You agree that any legal lawsuit or other action brought by us, you or any third party to enforce these Terms or any Service specific terms, or in connection with any matters related to the Platform, shall be subject only to the jurisdiction of the courts of Gurugram, Haryana, 122003. Where a dispute arises, the parties involved shall make all reasonable efforts to resolve the dispute through good faith negotiations. If efforts to amicably resolve any dispute or claim between the parties are unsuccessful, then such dispute or claim arising out of or in connection with the Terms or any Service specific terms, including any question regarding its existence, validity or termination, shall be referred to arbitration under the Arbitration and Conciliation Act, 1956, as amended (“Act”) before a Sole Arbitrator to be appointed mutually by us and you. The proceedings shall be conducted in English and the seat for arbitration shall be Gurugram (Haryana).
